THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS. YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

  1. Reservations may be made at any time and will be honored, provided payment is received as agreed and is deposited.
  2. Unlike the local real estate rental companies, we do NOT charge RESERVATION FEES.
  3. We will not send a rental agreement.  Print this document, sign and date each page as CONFIRMATION of your agreement, and either (a) copy and mail the original to the address below or (b) scan and email to the email address below.
  4. Reservation is booked upon receipt of the signed contract and the lesser of 50% of the total amount due or $1000. Balance is due 30 days before the arrival date.
  5. DEPOSIT may be paid by personal check, PayPal or Venmo. The deposit should be the LESSER OF  50% of the gross amount due, including tax and security deposit, or $900.  THERE WILL BE A TWENTY-SEVEN DOLLAR CHARGE FOR ANY RETURNED CHECK.  We will continue to market the property for rent until receipt of your deposit.   Upon our receipt of your initial deposit, your contract with us is bound.  If paying by check, please send a self-addressed stamped envelope with your deposit.  If for any reason the property has already been rented to another party when we receive the check, we will promptly return it to you in this envelope; otherwise, we will use the envelope to return your security deposit, at the appropriate time.
  6. BALANCE OF PAYMENT: The balance on the rent, all taxes and security deposit is due 30 days before arrival date. NO REMINDERS WILL BE SENT.  
  7. Use of fireplace is not included as an amenity in this contract.  Fireplace use is only with special permission and there is an extra charge of $30 for usage and cleaning. There is also an extra $400 refundable security deposit.
  8. Rental Deposits will be refunded in full on cancellations over 60 days in advance of the initial rental date. Rental Deposits will be refunded, less 15%, for cancellations 30-60 days prior to check in. Cancellations less than 30 days in advance will be refunded, less 15%, when/if the unit is re-rented.
  9. There will be no refund for inclement weather, unless the home is not available for rent or is inaccessible due to weather.   In the event of such event, the pro-rata share of the rental charge will be refunded.
  10. If for any reason we are unable to deliver the property to you for the rental period contracted (for example, the home is damaged by a severe storm), we shall refund your money in full.
  11. Any and all interest earned on deposits and advance rents paid will accrue to our benefit, and not the Renter.
  12. OCCUPANCY: The maximum number of people allowed at 255 Jumping Branch is 10. We rent to FAMILIES AND RESPONSIBLE ADULTS ONLY. Misrepresentation of the party will result in immediate termination of the rental agreement, expulsion, and the loss of rental fee. We reserve the right to refuse occupancy, if we feel the occupancy could be detrimental to the property.
  13. Rental Charge is based, in part, on number in party. Under no circumstances should there be more than 10 overnight occupants.   Violation of this provision may result in termination of occupancy, without refund.
  14. You must abide by the stated capacity of the house. Tents, campers or motor homes are not permitted.
  15. ABSOLUTELY NO PETS of any kind are allowed inside or outside of the rental property. If a pet is discovered on the premises, you will be charged a non-refundable fee of $125.00 Your security deposit will be forfeited, you will be asked to remove the pet immediately or vacate the premises with no refund.
  16. NO SMOKING OR VAPING in the house or anywhere on the property, including the boat dock and all decks, porches and patios.  No cigarette butts are to be littered on the grounds, anywhere. Smoking on the premises may result in immediate termination of occupancy with no refund.  If you are a smoker, please do not rent our home.
  17. Absolutely NO HOUSE PARTIES. Should a house party occur in the rental unit, occupancy will be terminated with no refund.
  18. CHECK-IN Time is after 3:00 PM on the first day, according to your reservation. You may go straight to the house when you arrive. You do not need to go by any office. If you anticipate arriving after 8:00 PM Eastern Time, please let us know your ETA by email or phone. If you wish to arrive early, let us know via email and we will see if the unit can be made available earlier.  
  19. KEYS are located at the rental house.  We will email you where to find the key upon receipt of the final payment and no less than 30 days prior to your arrival. Keys will not be given out to anyone other than the person whose name is on the reservation (or email address below), unless we have been given previous authorization.
  20. LOCK OUTS: If you lock yourself out of the house, please call or text the phone numbers below and leave a message. Our local emergency contact is Paul, who lives nearby.  Your call will be returned promptly and arrangements made to pick up the emergency key. There will be a $50.00 cash fee for opening the unit or providing a replacement key.  At the beginning of your stay, return the access key to its place so that a lockout cannot occur.
  21. CONSUMABLES:  We provide a starter supply only of consumable items such as toilet paper, paper towels, dish detergent and soap. We do not furnish charcoal.
  22. Other than the starter supplies listed above, paper products, cleaning supplies, and toiletries are not provided.
  23. One set of sheets per bed along with pillows, bedspreads and some blankets  are provided. Please notify us in advance if you plan to bring some of your own bed linens.
  24. One set of towels (bath towel, hand towel, washcloth and makeup removal cloth) are provided per person. We recommend that you bring extras.
  25. GARBAGE SERVICE is not available. Please plan to take your trash to the nearest dump site each day and on departure. As you plan for your garbage disposal, keep in mind on Sundays most dump sites are closed. If you want the cleaning service to take trash, there is a $3 for each normal size bag.  Please let us know if you will need this to be done.
  26. UTILITIES: Please be conservative in the use of utilities. When leaving for the day please turn off the lights and air conditioning.
  27. MAIL: We are not able to receive mail at the house. 
  28. TOILETS: Our home operates on a Septic Tank System.   Do not flush sanitary products or other foreign matter.
  29. GRILLS: Clean grills after each use. If the cleaning service needs to clean the grill, there is a $10 extra cleaning charge.  If the  gas grill is out of gas, purchase a refill and present your receipt for a refund. NEVER use charcoal in a gas grill.  We will reimburse you for half the cost.
  30. VEHICLES: No mobile sleeping units, such as campers, may be used at cottages for sleeping, cooking or any purpose other than transportation.
  31. PARKING is not permitted on the lawns, gravel or on the paved road. 
  32. LAKE RULES: All members of your party agree to follow the lake rules, which are in the notebook in the kitchen.  Canoes and kayaks must travel the lake in a counterclockwise fashion.
  33. RESPONSIBILITY FOR GUESTS: You are responsible for the actions of any family or guests you permit into the development.
  34. DAMAGE: While you are renting the house you are responsible for missing items or damage caused by yourself, your family, or guests. Any resulting charges will deducted from your deposit or charged to your security deposit. To avoid charges for prior damage, report any problem the day you check in.
  35. If you use any of the recreational/sporting equipment, you agree to use it with care, and repair or replace anything which you damage, destroy, or lose. For example, if you use the kayaks and one is lost, we ask that you go to Wal-Mart and replace it with one of like kind.
  36. DISTURBANCE: Respect the right of neighbors not to be disturbed and respect the rules and standards of the development where the house is located.
  37. FIREWORKS & FIREARMS: Fireworks may not be discharged in or near houses, lawns, or in the street.  Firearms are not permitted. Firearms are permitted on the premises for safety and protection purposes and must be stored away from children and those inexperienced in the safe handling of these weapons. Firearms may not be discharged unless there is an extreme emergency where lives are in peril.
  38. Please be aware that the locked closets are property of the owner and are not to be entered under any conditions. If upon arrival you discover any damage to the property, PLEASE NOTIFY US IMMEDIATELY.
  39. During your stay, report any non-emergency problems to us by calling, texting, or by email to the contact information below. Problems will be attended to promptly.  
  40. MAINTENANCE AND REPAIRS: We will do our best to keep all equipment in good repair. When you check in or during your stay, if you discover anything not in working order, please notify us immediately, by email or telephone call.   We will correct it as soon as possible.
  41. There will be NO REFUNDS or REBATES given due to the malfunctioning or breakdown of appliances, air conditioning, televisions, telephones, computer, printer, or any other property equipment or services.
  42. CHECK OUT time is 10:00 AM SHARP. No one is to be in the unit or on the unit property after check-out time.
  43. Each Renter is responsible for cleaning the rental property before leaving. While the final clean up is provided by the cleaning service, please leave the house as you would want your guests to leave your home. The cleaning service will perform a thorough sanitary service that includes cleaning all bathrooms, floor mopping and vacuuming and cleaning the kitchen, including refrigerator;  however, it is your responsibility to leave the home in good order for the cleaning service.
    1. Generally tidy up the home and make sure every thing is in order as you found it when you arrived.
    2. Clean all food out of refrigerator, wash and put away dishes, pots and pans or load and start the dishwasher (cleaning service will empty dishwasher).
    3. Wash any of our linens you borrow (just get them going in dryer when you leave, and cleaning service will do the rest).
    4. Remove trash from house and remove from premises. (Cleaning service can take away up to 1 double bag of trash; make sure it does not leak).
    5. Make sure all appliances are turned off, except the refrigerator, before departing. During air conditioning times, please turn the unit to 80 degrees upon departure. During heat months, please set heat to the lowest setting upon departure. In early spring and late fall, please turn the thermostat off when leaving.
    6. Turn off all lights except the front porch light and the exterior motion light at the front of the house.
    7. Close and lock all windows and doors.
    8. Return all keys to the storage place.
    9. Take your trash bags to the dump site.
  44. Renter is responsible for any damage incurred during his occupancy of the premises. We will not be held responsible for accidents, injury, or loss of valuables.
  45. Renter's Security Deposit will be refunded, if the unit is left in satisfactory condition. Refunds will be mailed within 30 days of the Renter's last day at the unit.
  46. INSPECTION OF PROPERTIES: The property shall be inspected after your departure. If damage does occur in the unit, please do not feel embarrassed, but report the damage to us immediately. We can handle the repair while you are here and alleviate any questions of both parties. If it is discovered that the owner's closet has been broken into after your departure, you will be charged the full replacement cost for all items that are missing plus any expenses that are incurred to replace the missing items.
  47. EVEN THOUGH WE DO NOT ASSUME RESPONSIBILITY FOR ANY ITEMS LEFT IN PROPERTY, we will make every effort to locate lost items. Upon request, we will mail items found to you. These items will be shipped COD plus a $10.00 handling fee
  48. I have read, understand, and agree to abide by these rules. I understand that violating these rules may result in eviction with no refund. I understand the cost of extraordinary cleaning, garbage removal, missing items, and damages may be deducted from my damage deposit.

    PLEASE NOTE THAT WE ADVISE YOU TO READ ALL OF THE INFORMATION PROVIDED HEREIN  REGARDING 255 JUMPING BRANCH AND OUR RULES SO THAT MISUNDERSTANDINGS OR INCONVENIENCES MIGHT BE PREVENTED.  IF THERE ARE ANY CONTRADICTIONS BETWEEN THIS DOCUMENT AND OTHER INFORMATION ON THE WEBSITE, THIS DOCUMENT SHALL TAKE PRECEDENCE.   RULES AND REGULATIONS ARE SUBJECT TO CHANGE FROM TIME TO TIME, BUT THE RULES APPLYING TO YOUR RENTAL, SHALL BE THOSE AS WRITTEN AND IN FORCE AT THE TIME AND DATE OF YOUR EXECUTION OF THIS AGREEMENT.

COVID-19 Policy and Liability

In the current pandemic environment, we are taking extra precautions to sterilize all surfaces areas including countertops, sinks, faucets, door handles, light switches, etc. Even with our best efforts, we cannot guarantee that our home is completely COVID-free. We accept no liability for an injury or death of any individual entering these premises if such injury or death results from the inherent risks of contracting COVID-19. You and your party are assuming this risk by entering these premises.

If anyone in your party is exposed or is suspected of having COVID-19 less than 14 days prior to your arrival, you may cancel your reservation and receive a full refund.
If anyone should experience a fever greater than 100.4 degrees during your stay at our home, or within 14 days after leaving, please contact us immediately.

I understand that the owners are not liable for visitor health and cannot be held responsible should any cases of COVID-19 occur after staying at their home.
